1. Procurement

What you must do

A State or Indian Tribe conducting procurement transactions under a Federal award must follow the same policies and procedures it uses for procurements with non-Federal funds; if no such policies and procedures exist, it must follow the procurement standards in 2 CFR 200.318 through 200.327.

When it applies

Applicant/recipient is a State or Indian Tribe and the award will fund procurement (contractual, equipment, supplies, or construction budget lines).

Even when using its own policies and procedures, a State or Indian Tribe must also comply with 2 CFR 200.321 (small/minority/women's/veteran-owned/labor-surplus business consideration), 200.322 (domestic preferences), 200.323 (recovered materials), and 200.327 (required contract provisions / Appendix II).

When it applies

State or Indian Tribe applicant with any procurement under the award, regardless of whether it uses its own procurement policies.

All other recipients and subrecipients, including subrecipients of a State or Indian Tribe, must follow the full procurement standards in 2 CFR 200.318 through 200.327.

When it applies

Applicant is not a State or Indian Tribe (e.g., nonprofit, local government, IHE, for-profit), or is any subrecipient (including a State's or Tribe's subrecipient), and the award will fund procurement.

When conducting procurement transactions under a Federal award, a State or Indian Tribe must follow the same policies and procedures it uses for procurements with non-Federal funds. If such policies and procedures do not exist, States and Indian Tribes must follow the procurement standards in §§ 200.318 through 200.327. In addition to its own policies and procedures, a State or Indian Tribe must also comply with the following procurement standards: §§ 200.321, 200.322, 200.323, and 200.327.
