Eligibility

PHAs with the legal authority to develop, own, modernize, and operate a public housing project in accordance with the 1937 Act are eligible. Tribes and tribally designated housing entities (TDHEs), nonprofit organizations, resident management corporations, and resident associations are not eligible to apply.Eligible applicants under this NOFO are troubled, substandard, receivership or high risk PHAs, as defined in the NOFO. Individuals, foreign entities, and sole proprietorship organizations are not eligible to compete for, or receive, awards made under this announcement.

Funding of approximately $11,500,000 is available through this NOFO. Subject to
appropriations, HUD reserves the right to award fiscal year 2026 funds based on this NOFO
competition.
Additional funds may become available for award. Use of these funds is subject to statutory

The $11.5 million is available to improve public housing performance in two core areas:
• Physical Condition: Improve the physical condition of public housing. Successful
applicants must demonstrate a comprehensive strategy on how the funds will provide
residents access to safe, accessible, and decent public housing through improved
public housing assets.
• Management: Increase occupancy and reduce long-term vacancies through capital
investment.

You are invited to apply if your organization is an eligible entity type and meets the funding
conditions included in the NOFO. HUD will review applications from eligible applicants using
the criteria in Section V. of this NOFO.

• Moving to Work Agencies - PHAs participating in the Moving to Work Demonstration
Program (MTW)
The following entities are not eligible for funding:
• Tribes and tribally-designated housing entities (TDHEs), nonprofit organizations, and
resident associations
• Foreign entities and sole proprietorship organizations
• Individuals
2. Restrictions
a. Statutory and Regulatory Requirements Affecting Eligibility
You must comply with the current General Statutory and Regulatory Requirements Affecting
Eligibility for HUD’s Competitive Programs. HUD will review your eligibility before issuing an
award. As part of this review, HUD uses SAM.gov and Department of Treasury data.
b. Application Eligibility
Your application is considered for funding if it satisfies the application review requirements in
Section V. of this NOFO.
1. You cannot submit more than one application.
2. Each application can only request funding for one public housing asset management
project (AMP), which may include multiple properties or scattered sites. The AMP name,
number, and address(es) in the application must match the name, number, and address(es)
in PIC. If more than one AMP is proposed in the application, the entire application is ineligible
for funding.
3. An AMP is not eligible to receive funding if the AMP has previously been awarded funding
under this program. If an AMP received funding in previous funding rounds, but only received

a partial grant due to limited funding availability, you may apply for the remaining amount of
the original request.
4. Your application may include more than one eligible activity.
5. Funding requests that are less than the minimum award amount, or over the maximum
award amount are ineligible.
6. You are ineligible for funding if you do not submit: a) a narrative response as described in
Section IV.B.2, and b) a completed form HUD-50075.1 Parts I and II including the proposed
activities for this grant application for Rating Factor 3, Soundness of Approach.
7. Restrictions on Rental Assistance Demonstration (RAD) Projects: You cannot use the
funds awarded under this NOFO for any projects that are part of the Rental Assistance
Demonstration (RAD) program, specifically those with “Commitments to enter into Housing
Assistance Payments Contracts” (CHAPs).
For a property with a CHAP, HUD will assume all units are part of the CHAP, even if the
agreement is being implemented in phases and some units are not yet covered. If a CHAP is
issued after funds are awarded under this NOFO, the AMP will no longer be eligible for this
program, and the remaining funds will need to be returned. HUD will determine if all grant
funds should be returned.
If you are awarded a grant, you may be required to periodically certify to HUD that funded
work is not occurring in an IMS/PIC development that is subject to a CHAP.
8. Relation to Repositioning (Non-RAD): Funds from this grant cannot be used for
properties that are in the process of converting to another federal housing program, such as
Section 18 disposition or demolition.
HUD will consider ineligibility to start when an application for Section 18 demolition or
disposition is approved by HUD's Special Application Center. If a Section 18 approval is
issued after funds are awarded under this NOFO, the AMP will no longer be eligible for this
program and the remaining funds will need to be returned. HUD will determine if all grant
funds should be returned.
If you are awarded a grant, you may be required to periodically certify to HUD that funded
work is not occurring in an IMS/PIC development that is subject to a Section 18 demolition or
disposition approval.
c. Additional Restrictions on Project Activities:
You must review the following restrictions to ensure your application is compliant. If you are
selected for funding, you are expected to implement the applicable requirements. HUD
reserves the right to approve or disapprove any activity and may adjust grant budget amounts
accordingly within individual grants.

• Activities under this NOFO must comply with 24 CFR Part 905.
• Funding can only be used for the activities to improve the physical condition of public
housing and/or increase occupancy and reduce long-term vacancy at the AMP
specified in the application.

A. Purpose
The Capital Improvements for At-Risk/Receivership/Substandard/Troubled PHAs program
provides competitive awards to PHAs that are either in receivership, designated troubled or

B. Goals and Objectives
The goal of this program is public housing asset improvement. To achieve this, the program
focuses on the following objectives:
• Physical Condition: Improve the physical condition of public housing.
• Management: Increase occupancy and reduce long-term vacancies through capital
investment.
C. Authority
This program is authorized by Section 9 of the United States Housing Act of 1937 (42 U.S.C.
1437g) (1937 Act). Funding for this program is provided by the Full-Year Continuing
Appropriations and Extensions Act, 2025 (Public Law 119-4 enacted March 15, 2025).
Grants awarded under this program are subject to Public Housing Capital Fund Program
regulations (24 CFR Part 905) including relocation requirements (24 CFR Part 905, Subparts
B and C). Temporary relocation of residents must also be carried out in compliance with all
applicable fair housing and nondiscrimination requirements at 24 CFR 5.105 and 24 CFR
Part 5, Subpart L.
D. Unallowable Costs
Activities under this NOFO must comply with Capital Fund regulations at 24 CFR Part 905
with the following additional restrictions:
• Funds cannot be used for any activities other than for Capital Fund Program (CFP)
activities identified in the application to improve the physical condition of public
housing and/or increase occupancy and reduce long-term vacancy.
• Funds may only be expended at the AMP proposed on the form HUD-50075.1
submitted as part of this application. Funds may not be expended at any other
IMS/PIC or HIP Development(s)/AMP(s) that are not funded under this grant.

• You must use funds for activities covered under Budget Line Item (BLI) 1480 (General
Capital Fund Activities). Activities associated with other BLIs are unallowable,
including but not limited to BLI 1410 (Administrative Costs), BLI 1408 (Management
Improvements), and BLI 1406 (Transfer to Operations). See Section II.A.2,
Restrictions, and 24 CFR 905 for additional information on eligible costs and activities.
• Awards made under this opportunity may not be used to pay for grant writing services.
• PHAs are not permitted to use any amount of any award under this NOFO to
reimburse for eligible Capital Fund activities that were already funded by another
source. All Capital Fund obligations, expenditures, and disbursements must be
recorded to the appropriate grant.
• Per 24 CFR 905.300, PHAs cannot spend Capital Funds on any work that is not
included in an approved CFP 5-Year Action Plan and its amendments.
E. Indirect Costs
If you expect to charge indirect costs to the award, submit the Indirect Cost Rate Certification
form (HUD-426) with your application.
F. Program History
Changes from previous NOFO versions:
• Provisions related to racial equity and climate change are eliminated. You are
encouraged to thoroughly review the reformed application guidelines to align with
these necessary and refocused priorities.
• Section II.A, Eligible Applicants, excludes AMPs for funding that have previously been
awarded funding under this program. If an AMP received funding in previous funding
rounds but only received a partial grant due to limited funding availability, you may
apply for the remaining amount of the original request.
• Section V.B, Merit Review, has been updated to include the selection process for tied
scores.
• The point distribution for Rating Factor 3 sub factor (c) and (d) have been changed to a
maximum of 15 points each.
• Some titles, descriptive language and instructions are revised to enhance clarity.

V. APPLICATION REVIEW INFORMATION
A. Threshold Review
HUD reviews each application to make sure it meets the following threshold requirements. If
you meet all threshold requirements, your application will advance to a merit review. If you fail
to meet one or more threshold requirements, your application is not eligible for HUD funding.
1. Eligible Applicant
You must meet the applicant eligibility criteria in this NOFO. Applications from ineligible
applicants are not rated or ranked and will not receive HUD funding.
2. Resolution of Civil Rights Matters
Applicants with outstanding, unresolved judgments against them for violations of civil rights
laws must resolve those judgments before the application submission deadline or the
applicant will be deemed ineligible.
a. An applicant is ineligible for funding if the applicant has received notice of a judgment
imposed against them for violations of:
1. the Fair Housing Act or a substantially equivalent state or local fair housing law for
discrimination because of race, color, religion, sex, national origin, disability or familial
status; or
2. Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973,
Section 109 of the Housing and Community Development Act of 1974, the Americans
with Disabilities Act, or the Violence Against Women Act or substantially equivalent
state or local laws.
b. HUD will determine if actions to resolve the judgment taken before the application deadline
date will resolve the matter. Examples of actions that may be sufficient to resolve the matter
include, but are not limited to:
1. Current compliance with a voluntary compliance agreement signed by all the parties;
2. Current compliance with a HUD-approved conciliation agreement signed by all the
parties;
3. Current compliance with a conciliation agreement signed by all the parties and
approved by the state governmental or local administrative agency with jurisdiction
over the matter;
4. Current compliance with a consent order or consent decree; or
5. Current compliance with a final judicial ruling or administrative ruling or decision.
3. Timely Submission of Applications
Late applications are not eligible for funding. See deadlines in Section VI of this NOFO.

HUD expects to evaluate and score your application using the following merit criteria and process.
Merit reviewers evaluate and score all applications that pass the threshold review. Merit reviewers
may include Federal and non-Federal persons. Reviewers receive a copy of your application to
evaluate and score each application separately.
Merit Review Process
1. Each eligible application is evaluated and scored by two independent reviewers based solely
on the rating factors described in section V.B.1 of this NOFO.
2. A final panel will review the independent evaluations and scores to identify and rectify
inconsistencies between independent reviewers and to ensure the rating accurately reflects
the contents of the application.
3. A final score is assigned to each application based on the scores described in this section and
applications are ranked in score order. The most highly rated applications are recommended
for award selection, subject to the amount of available funding, in accordance with the
allocation of funds described in section I of this NOFO.
4. Tied Scores. If two or more applications have the same score and there are insufficient funds
to fund all of them, HUD will rank higher the application that earned more points for Rating
Factor 2: Need. If a tie remains, then HUD will rank higher the application(s) with the highest
score for Rating Factor 3: Soundness of Approach. For further tied applications, HUD will rank
higher the application that earned more points for Rating Factor 4: Past Performance. If there
are more eligible applications assigned the same score after the tie break is applied, a lottery
will be held to determine the ranking of applications.
5. HUD may use the results of the risk review to make funding decisions and to apply award
conditions.
1. Rating Factors
Your application must include a response to the following criteria.
You should be certain that each rating factor is adequately responded to in your application
and that all applicable information requested by the NOFO is provided. If the response to a
specific rating factor cites information provided in the response to another factor, clearly
indicate where the information is located so the information can be easily located by the
reviewer. To be awarded full points for each rating factor, you must provide comprehensive,
high-quality responses to each of the requested items in each factor.

Rating Factor 1: STATUS OF PHA
Maximum Points: 20
a. PHAS Designation and Receivership Status. Funding is prioritized to PHAs where
capital improvements may have the most significant impact on the PHA’s PHAS designation.
You do not need to submit information for this rating factor. Points will be awarded based on
the status of the PHA’s most recent PHAS designation of record or receivership/possession
status as of the NOFO deadline. If you believe the information utilized by HUD is incorrect,
incomplete, or missing, you should work with HUD's Real Estate Assessment Center (REAC)
to ensure HUD's systems or reports are submitted, updated, or corrected prior to application
deadline. PHAS designations are issued to PHAs by REAC via email and can be found online
in HUD’s Secure Systems at any time. There will be no application extension waivers granted
for the purposes of amending systems of record. Points will be scored according to the

Maximum Points: 30
HUD will evaluate your need based on the AMP’s physical condition, occupancy rate, and
long-term vacancies. You do not need to submit information for this rating factor. The below
subfactors indicate where HUD will draw the information to calculate the score. If you believe
that the information utilized by HUD in the three sections below is incorrect, incomplete, or
missing, you should work with your assigned HUD public housing office to ensure HUD
systems or reports are submitted, updated, or corrected prior to application deadline. There
will be no application extension waivers granted for the purposes of amending systems of
record.

c. Long-Term Vacancies (10 points). Units that have been vacant for extended periods of
time typically have greater capital needs to make the unit ready for a tenant. HUD will use the

Points for this rating factor are earned based on the completeness of Form
HUD-50075.1. To earn points for this rating factor, you must complete
Form HUD-50075.1, Parts I and II, as described in Section IV.B. The form

must include the AMP name, number, and address(es) as identified in the
IMS/PIC or HIP system. Fewer points will be awarded for missing or
incomplete items.
This sub factor will be evaluated based on the Form HUD-50075.1 as well
as the Rating Factor 3 Narrative. You must demonstrate that the proposed
expenditures will represent a highly efficient and effective use of HUD
grant resources. To get the most points, you must provide a clear and
detailed breakdown of work activities and estimated costs. You must also

indicate how costs were determined, including quantity and unit
measures/hours works, as applicable. Fewer points will be awarded for
lack of clarity, lack of detail, not responding fully to the criteria, or
proposing ineligible use of funds. See Section III.D. for more information

describes your capital improvement strategy for improving the AMP's
performance and your capacity to execute the grant. Your narrative should

improvements will address the deficiencies identified within the
report.
• Describe how the proposed use of funds aligns with correcting the
deficiencies contained in the most recent physical inspection report.
Impact on Performance — Occupancy.
• Provide justification that the capital improvements at the AMP will
increase occupancy at the AMP.
• Describe your strategies for leasing units quickly and with

comprehensive marketing.
• Using the most recently approved audited FDS submission as a
baseline, you should provide a sound basis for determining that the
capital improvements at the targeted AMP will increase the unit-
months leased.

• You must project what you believe the occupancy rate will be once
the work is completed. The projection must be supported in the
narrative with appropriate occupancy strategies and be reasonably
based upon the time frames identified for the completion of the
capital improvements.
Rating Factor 4: PAST PERFORMANCE
Maximum Points: 5
a. Compliance with Current Monitoring (5 points). For this element, HUD will determine
point scores that, in HUD’s sole determination, reflect the extent to which the PHA is
compliant with monitoring requirements. The applicant does not need to submit any
documentation pertaining to this rating factor.
HUD will evaluate this rating factor based upon your history complying with HUD monitoring
requirements, as determined by the assigned HUD field office. While compliance with any
and all such requirements will be considered, HUD will pay particular attention to cases in
which you are under a specific remedial agreement (e.g., a troubled Recovery Agreement
and Action Plan, Voluntary Compliance Agreement, or court order) or is subject to a
compliance management plan (e.g., a Corrective Action Plan or Shortfall Improvement Plan).
To receive maximum points, you must have recently been and currently compliant on
meeting all reporting requirements. You will receive partial points if most, but not all, reports
are considered compliant.
2. Other Factors
Your application must respond to the following other additional criteria.
a. Budget
The panel will review but not approve the budget. The panel will assess whether the budget
aligns with planned program activities and objectives. Panel members will consider whether
the budget and the requested performance period are fully justified and reasonable in relation
to the proposed project.

C. Risk Review
Before making an award, HUD will evaluate each applicant’s likelihood of successfully
implementing an award based on the following criteria.
• OMB-designated repositories of governmentwide data, as noted in 2 CFR 200.206(a)
• Other public sources such as newspapers, Inspector General or Government
Accountability Office reports or findings, or other complaints that have been proven to
have merit
• Financial stability
• Quality of management systems and ability to meet the management standards
prescribed in 2 CFR part 200
• History of performance. The applicant’s record in managing Federal awards, if it is a
prior recipient of Federal awards, including timeliness of compliance with applicable
reporting requirements, failing to make significant progress in a timely manner, failing
to meet planned activities in a timely manner, conformance to the terms and conditions
of previous Federal awards, and, if applicable, the extent to which any previously
awarded amounts will be expended prior to future awards
• Reports and findings from audits performed under 2 CFR part 200, subpart F—Audit
Requirements or the reports and findings of any other available audits
• The applicant's ability to effectively implement statutory, regulatory, or other
requirements imposed on non-Federal entities
• Capacity of the applicant, including staffing structures and capabilities
• History of timely completion of activities and receipt and expenditure of promised
matching or leveraged funds
• Ability to promote self-sufficiency and economic independence
• Ability to produce positive outcomes and results
HUD may use the results of the risk review to make funding decisions and to apply award
conditions.
D. Selection Process
When making funding decisions, HUD will consider:
• Eligibility requirements, including threshold review results.
• Merit review results.
• Risk review results.
To the extent allowed by law, HUD may:
• Fund applications in whole or in part.
• Fund applications at a lower amount than requested.

• Choose to fund no applications under this NOFO.
• Adjust funding for an application, to ensure funding or geographic dispersion, and
alignment with program or administrative priorities.
• Withdraw an award offer and make an offer of funding to another eligible application, if
terms and conditions are not finalized or met.
• Use additional funds made available after NOFO publication to either fully fund an
application or fund additional applications.
• Correct HUD review and selection errors. If HUD commits an error that causes an
applicant not to be selected, HUD may make an award to that applicant when and if
funding is available.
• Release another NOFO, if funding is available and if HUD does not receive
applications of merit.
E. Award Notices
If you are successful, HUD will email an award notice to the authorized official representative
from the SF-424. HUD will also notify unsuccessful applicants.
The award notice communicates the amount of the award, important dates, and the terms
and conditions you need to follow. HUD may impose specific conditions on an award as
provided under 2 CFR 200.208.
You agree to the award terms and conditions by either drawing funds from HUD’s payment
system or signing the agreement with HUD. If you do not agree to the award terms and
conditions, HUD may select another eligible applicant.
HUD reserves the right to negotiate the award terms and conditions, including payment
terms, prior to executing an award.

You must apply electronically. See Find the Application Package to make sure you have
everything you need to apply online. See Application Waiver if you qualify to submit a paper
application.
Make sure you are current with SAM.gov and UEI requirements before applying for the
award. See the Before You Begin section of this NOFO.
A. Deadlines
1. Application submission deadline:
The application deadline is 11:59:59 PM Eastern time on:
04/28/2026
HUD must receive your application by the deadline. Applications received after the deadline
are late. Late applications are not eligible for HUD funding.
If HUD receives more than one application from you, HUD will review only the last
submission.
HUD may extend an application due date based on emergency situations such as
Presidentially-declared natural disasters. Improper or expired registration and password
issues are not causes to allow HUD to accept applications after the deadline date.
2. Grace Period for Grants.gov Submissions
If Grants.gov rejects your application before the deadline, you have up to 24 hours after the
application deadline to correct and resubmit your application. Any application submitted
during the grace period but not received and validated by Grants.gov will not be considered
for funding. There is no grace period for paper applications.
B. Submission Methods
1. Electronic Submission
You must register and submit your application through Grants.gov. See Before You Begin.
For instructions on how to submit in Grants.gov, see the Quick Start Guide for Applicants.
Make sure that your application passes the Grants.gov validation checks or we may not get it.
Grants.gov will record the date and time of your application submission. HUD will use this
information to determine timely applications.

2. Electronic Submission Application Waiver
You may request a waiver from the requirement to submit your application electronically. The
request must show good cause and detail why you are technologically unable to submit
electronically. An example of good cause may include: a valid power or internet service
disruption in the area of your business office. Lack of SAM.gov registration is not good cause.

request to HUD. You must submit your waiver request at least 15 calendar days before
the application deadline.
C. Other Submissions
1. Intergovernmental Review
This NOFO is not subject to Executive Order 12372. No action is needed.
2. Technical Application Errors
HUD may contact you to fix a technical error with your timely application after the due date.
Technical errors that you may fix are not submitted to satisfy merit review criteria. And you
may not fix technical errors related to threshold review except eligibility entity documentation.
Examples of technical errors include: inconsistencies in funding requests; improper signature
on a form; a missing or incomplete form; and nonprofit status documentation.
HUD will send notice to the authorized organization representative from the SF-424 to fix a
technical error.
Your application is not eligible for funding, if you fail to fix the error to HUD’s satisfaction and
by the due date in HUD’s notice. HUD will not review information submitted after the
application due date in HUD’s notice.
a. Fix Errors in Electronic Applications
To fix an error in response to a HUD notice, you must email the corrections to HUD at
applicationsupport@hud.gov. The subject line of the email to applicationsupport@hud.gov
must state “Technical Fix” and include the Grants.gov application tracking number (e.g.,
Subject: Technical Fix - GRANT123456). If you do not email applicationsupport@hud.gov or
if you do not include the appropriate subject line, HUD may mark your application as
ineligible.
HUD allows no less than 48 hours and no more than 14 calendar days from the date of the
HUD notice to fix an error. If the due date to fix an error falls on a Saturday, Sunday, Federal
holiday, or on a day when HUD’s Headquarters office in Washington, DC is closed, then the
due date is the next business day.
b. Fix Errors in Paper Applications
You must fix an error in your paper application, in accordance with HUD’s notice. If your
paper application includes an incorrect UEI, HUD will request you supply the correct UEI.
D. False Statements
By submitting an application, you acknowledge your understanding that providing false or
misleading information during any part of the application, award, or performance phase of an
award may result in criminal, civil or administrative sanctions, including but not limited to:
fines, restitution, and/or imprisonment under 18 USC 1001, 18 USC 1012, 18 USC 1010, 18
USC 1014, or 18 USC 287; treble damages and civil penalties under the False Claims Act, 31
USC 3729 et seq.; double damages and civil penalties under the Administrative False Claims
Act, 31 USC Sections 3801-3812; civil recovery of award funds; suspension and/or
debarment from all federal procurement and non-procurement transactions, FAR Part 9.4 or 2

1. Environmental Review
You must follow these environmental review requirements, including regulations at:
24 CFR part 58
In compliance with the federal requirements applicable to all Capital Fund activities at 24
CFR 905.308 including environmental review requirements at 24 CFR 905.308(b)(2), all
activities under this NOFO are subject to an environmental review by a responsible entity
under HUD's environmental regulations at 24 CFR part 58 and must comply with the
requirements of the National Environmental Policy Act of 1969 (NEPA)(42 U.S.C. 4321 et
seq.) and the related laws and authorities listed at 24 CFR 58.5. HUD may make a finding in
accordance with 24 CFR 58.11 and may perform the environmental review itself under the
provisions of 24 CFR part 50. In those cases where HUD performs the environmental review
under 24 CFR part 50, it will do so before approving a proposed project, and will comply with
the requirements of NEPA and the related requirements at 24 CFR 50.4.
The Responsible Entity, PHA, and their contractors may not acquire, rehabilitate, convert,
lease, repair, dispose of, demolish, or construct property for a project under this NOFO, or
commit or expend HUD or non-HUD funds for such eligible activities under this NOFO, until
the responsible entity has completed the environmental review procedures required by 24
CFR part 58 and the environmental certification and Request for Release of Funds (RROF)
have been approved, if applicable, or HUD has performed an environmental review under 24
CFR part 50 and the recipient has received HUD approval of the property.
2. NOFO Impact Determination Related to the Environment
This NOFO provides funding under, and does not alter the environmental requirements of, 24
CFR part 905. So, under 24 CFR 50.19(c)(5)(i), this NOFO is categorically excluded from
environmental review under the National Environmental Policy Act of1969 (42 USC § 4321).
Activities under the NOFO are subject to environmental review requirements at 24 CFR
905.308(b)(2).
3. Lead-Based Paint Requirements
You must follow the lead-based paint rules below if you fund any work on pre-1978 housing.
This includes buying, leasing, support services, operating, or work that disturbs painted
surfaces.
• HUD’s rules (Lead Disclosure Rule; and Lead Safe Housing Rule).
• EPA’s rules (Renovation, Repair and Painting Rule, and Lead Abatement, Inspection
and Risk Assessment Rule).
C. Remedies for Noncompliance
HUD may terminate all or a part of your award as described under 2 CFR 200.340 through
200.343 pursuant to the terms and conditions of your award, including, to the extent
authorized by law, if an award no longer effectuates the program goals or agency priorities.

D. Reporting
HUD requires recipients to submit the performance, financial, and program reports as
outlined below. You must comply with these reporting requirements to remain eligible for
HUD funding. See Section VII.C. of this NOFO.
HUD is implementing new grants management and reporting tools, which will be rolled out for
your use in the near term. As a grantee, you will be required to report on grant performance
and financial activities (including vendor and cash disbursement supporting details for
yourself and your sub-recipients) using these new tools when they are released. HUD will
work with you to support your transition to this new reporting environment. Once
implemented, timely reporting in this new environment will be mandatory. HUD reserves the
right to exercise all available rights and remedies for any noncompliance with these grants
management and financial reporting requirements, to include requiring 100% review or
stopping future disbursements altogether if reporting is not timely submitted.

1. Performance Deadlines
PHAs must follow specific deadlines when using funds from the Capital Fund program. These
deadlines are set by Section 9(j) of the 1937 Act.
Unless HUD gives an extension, PHAs must commit to spending at least 90% of their grant
within 24 months of receiving the funds. A commitment is a signed agreement with another
party for work or financing that will use these funds.
All grant money must be spent within 48 months after receiving the funds. Unlike the initial
commitment deadline, no extensions are allowed for the spending deadline.
2. EPIC and Other Reporting
• If you are awarded under this program, you must use EPIC to complete annual reports
within 60 days of each annual anniversary of award. All other reporting (e.g. in
financial systems) already required in the Capital Fund formula grant program or the
Moving to Work program shall continue to apply.
• If you are awarded, you must update your Five-Year Action Plan and Annual Plan in
EPIC after award. Plans must be reviewed by the Office of Capital Improvements
(OCI) and approved by the assigned Public Housing Field Office before work can
commence.
• Moving to Work (MTW) PHAs will be required to identify proposed activities in EPIC
under Budget Line Item (BLI) 1480 General Activities and may not use the simplified
Five-Year Action Plan described in PIH Notice 2016-21(HA).
• You must have the necessary processes and systems in place to comply with this
Award Term, if you receive an award, unless an exception applies under 2 CFR
170.110.

1. Standard Definitions
For standard definitions not listed below, refer to 2 CFR 200.1.
Affirmatively Furthering Fair Housing (AFFH) - statutory obligation to affirmatively further
the purposes and policies of the Fair Housing Act (see also 24 CFR 5.151, as amended by
90 FR 11020).
Authorized Organization Representative (AOR) is the official within your organization with
the legal authority to: give assurances, make commitments, submit your application to HUD,
enter into agreements, and execute such documents on behalf of your organization. The
AOR is not necessarily the Project Director. The AOR has defined privileges within
Grants.gov.
Consolidated Plan has the same meaning as defined at 24 CFR part 91.
E-Business Point of Contact (E-Biz POC) is defined at Grants.gov.
Eligibility requirements are mandatory requirements for an application to be considered for
funding.
Grants.gov is the website serving as the Federal government’s central portal for searching
and applying for federal financial assistance.

At-Risk. A PHA that is neither troubled nor substandard under the Public Housing
Assessment System (PHAS) but has at least one AMP that scored less than 60 percent on
its most recent Uniform Physical Condition Standards (UPCS) or National Standards for the
Physical Inspection of Real Estate (NSPIRE) inspection, whichever scoring method is most

Housing Information Center (IMS/PIC or HIP) serves as a national repository of information
related to PHAs, HUD-assisted families, HUD-assisted properties, and other HUD programs

IMS/PIC or HIP Development/AMP. A grouping of a PHA’s buildings as identified with the
IMS/PIC or HIP development number in HUD data systems. In this NOFO, this term will

Receivership PHA. A PHA of which HUD has taken possession or is under HUD’s control, or
a PHA that is subject to an appointment of a receiver (which may be another PHA or a private

Substandard PHA. A PHA that is designated as substandard under PHAS pursuant to 24
